Trade Marks Ordinance, 2001 — section 53

53. Infringement goods, material or articles may be treated as prohibited..—_(1) The proprietor of the registered trade mark may give notice in writing to the 1[Director General, IPR (Enforcement), Director, IPR (Enforcement) or Collector of Customs or any competent authority under the Custom Act, 1969 (IV of 1969)] that

(a)he is the proprietor of the registered trade mark;

(b)at a time and place specified in the notice, goods which, in relation to that registered trade mark are infringing goods, material or articles, or bear false indications as to their source or the identity of their manufacturer are expected to arrive in Pakistan from outside Pakistan and that they are subject to the control of the customs authorities under the Customs Act, 1969 (IV of 1969); and

(c)he requests the 1[Director General, IPR (Enforcement), Director, IPR (Enforcement) or Collector of Customs or any competent authority under the Custom Act, 1969 (IV of 1969)] to treat such goods as prohibited goods.
